Probate is required when someone dies with assets exceeding $184,500 in California that are not held in a trust or designated as joint tenancy. Many people mistakenly believe they can avoid probate altogether, but it’s crucial to consult with an experienced attorney to determine if your situation warrants the process.
Understanding the Probate Process: Filing a Petition
Brenda, you mentioned identifying assets and paying debts. Can you elaborate on the specific steps involved in the probate process?
Absolutely. One crucial early step is filing a petition for probate with the court. This involves completing Form DE-111, requesting to be appointed as the executor or administrator of the estate. The original will must also be submitted if one exists.
Consequently, this initiates the formal legal proceedings and sets the stage for the subsequent steps, such as providing notice to heirs and creditors.
Challenges in Filing Probate Petitions
Steve, have you encountered any particular challenges when filing probate petitions?
It’s not uncommon to face hurdles. For instance, locating beneficiaries who may be estranged or difficult to contact can delay the process. I recall one case where an heir resided overseas and was unaware of their inheritance for several months. We eventually tracked them down through a series of international inquiries, highlighting the importance of thorough investigative work.
Moreover, incomplete documentation or discrepancies in the will can complicate matters. In another instance, a client’s will lacked specific instructions regarding digital assets, leading to ambiguity and potential conflicts among beneficiaries. It underscored the need for comprehensive estate planning in the digital age.
