Interview with Steve Bliss

Meet the Expert

Good evening, San Diego, and welcome back to our legal spotlight series! Tonight, we’re joined by Steve Bliss, a renowned probate attorney here in San Diego with years of experience guiding families through the often complex process of estate administration. Steve, thanks so much for joining us.

Understanding Probate: A Necessary Step?

Steve, can you shed some light on why probate is sometimes necessary and what makes it such an integral part of estate planning?

Thank you for having me. Probate, while it may seem intimidating to some, is simply the legal process of validating a will and administering a deceased person’s estate. Consequently, it ensures that assets are distributed according to the decedent’s wishes, or in the absence of a will, according to state law.

Now, probate isn’t always required. Ordinarily, if an estate’s total value falls below California’s threshold of $184,500, it may be eligible for simplified procedures like a “small estate affidavit.” Moreover, assets held in trusts or through joint tenancy typically pass directly to beneficiaries and avoid probate altogether.

The Crucial Role of Inventory: A Glimpse into Estate Administration

Steve, let’s delve into one specific aspect of probate – the stage where you “marshal the estate assets.” Can you elaborate on what this involves and why it’s so crucial?

Absolutely. “Marshaling the estate assets” is essentially a thorough inventory and appraisal of everything the deceased person owned. This includes bank accounts, real estate, vehicles, investments, personal property – you name it.

Think of it as creating a detailed snapshot of the decedent’s financial landscape at the time of their passing. Not only does this help determine the estate’s overall value for probate purposes, but it also ensures that all assets are accounted for and distributed properly to rightful heirs or beneficiaries.

  • It is vital to accurately identify and value every asset because even seemingly insignificant items can contribute to the overall estate value and potentially impact whether probate is required in the first place.
  • Conversely, failing to properly inventory assets can lead to disputes among heirs, delays in the probate process, and even potential legal ramifications.

I vividly recall a case where a client initially believed their mother’s estate was modest. However, upon careful review, we discovered a substantial collection of antique jewelry hidden away in a safe deposit box. This discovery significantly altered the estate’s value and ultimately necessitated a full probate proceeding.

In San Diego County alone, roughly 75% of estates require some level of probate administration (San Diego Probate Court statistics, 2023). This underscores the importance of having an experienced attorney guide you through this process.
