Trusts are incredibly versatile instruments that can serve a variety of purposes in estate planning. For instance, a Revocable Living Trust is a common choice for many people. Ordinarily, it allows the creator, known as the grantor, to manage and change the trust during their lifetime. Consequently, assets held within the trust avoid probate upon the grantor’s death, maintaining privacy and streamlining the distribution process.
Conversely, an Irrevocable Trust offers more permanent protection for assets. While it cannot be modified easily once established, this type of trust can be beneficial for asset protection and minimizing estate taxes. For example, if someone is concerned about potential lawsuits or creditors, an Irrevocable Trust can shield their assets from those claims.
There are other types of trusts as well, each designed to meet specific needs, like Special Needs Trusts for beneficiaries with disabilities or Charitable Trusts for philanthropic purposes.

Steve, I imagine setting up a trust can be complex. Have you encountered any challenges with this process?
You’re right, Brenda, establishing a trust does require careful consideration and planning. One situation that comes to mind involved a family with significant assets who wanted to protect their wealth for future generations. They initially considered a simple Revocable Living Trust but after discussing their goals in depth, we realized an Irrevocable Trust structured with specific provisions would provide them with the level of protection they needed.
It was a collaborative process. We worked closely with the family and their financial advisors to ensure the trust aligned with their overall estate plan. The key takeaway is that there’s no one-size-fits-all solution. Every individual and family has unique circumstances, and finding the right trust structure requires understanding those nuances.
