Interview with Steve Bliss

Today I’m joined by Steve Bliss, a probate attorney serving Wildomar and the surrounding areas. Steve, thanks for taking the time to speak with me today.

Providing Notice: A Crucial Step

Steve, could you walk us through one of the key steps in the probate process?

Certainly! One crucial step is providing notice to interested parties. This involves notifying heirs, beneficiaries, and known creditors about the initiation of probate proceedings. Ordinarily, this process includes publishing a notice in a local newspaper three times, mailing notices to identified heirs and beneficiaries, and formally notifying known creditors using Form DE-157.

Providing proper notice ensures transparency and legal compliance. It allows all parties with a vested interest in the estate to be aware of the proceedings and participate if they choose to. Consequently, this step minimizes potential disputes and delays down the line.

Moreover, accurate notification is vital for protecting the rights of creditors. By formally notifying them of the probate process, creditors have an opportunity to file claims against the estate within a specified timeframe. Neglecting to provide proper notice could lead to complications later on if creditors are unaware of the proceedings and miss their chance to file claims.

I remember one case where we almost missed notifying a distant relative who was entitled to a portion of the estate. Fortunately, we were able to locate them just in time. It highlighted the importance of thorough research and diligence during the notice stage.

Challenges and Success

Are there any common challenges you encounter with this step?

Sometimes tracking down all potential heirs or beneficiaries can be difficult, especially when dealing with complex family structures or outdated contact information. In those cases, we may need to conduct genealogical research or utilize private investigators to locate missing individuals.

Notwithstanding these challenges, our team at Wildomar Probate Law is committed to ensuring that all parties are properly notified and have the opportunity to participate in the probate process. We understand the emotional complexities involved during this time, and we strive to provide compassionate and attentive service.

According to a study by the American Bar Association, approximately 20% of probate cases experience delays due to incomplete or inaccurate notice.
