Interview with Steve Bliss

Steve, Thanks for Joining Us Today

Welcome to our program, Steve Bliss! We’re delighted to have you here today to shed some light on the complex world of probate law.

Can You Briefly Explain What Probate Is and Why It’s Important?

Probate is a legal process that occurs after someone passes away. It involves validating their will (if they have one), identifying and inventorying their assets, paying off any debts and taxes owed by the estate, and finally distributing the remaining assets to the heirs or beneficiaries.

It’s important because it ensures that the deceased person’s wishes are carried out and that their assets are distributed fairly and according to the law. Without probate, there could be disputes among family members about who inherits what, which can lead to costly and time-consuming legal battles.

What Are Some Common Ways People Can Avoid Probate?

One of the most effective ways to avoid probate is by setting up a revocable living trust.

Consequently, assets placed in a revocable living trust do not have to go through probate upon the grantor’s death because they are already owned by the trust.

The trustee, who you designate, manages and distributes the assets according to your instructions outlined in the trust document. This can save your loved ones significant time, expense, and stress during an already difficult time.

You Mentioned Revocable Living Trusts. Can You Elaborate on How They Work and What Makes Them a Good Choice for Many People?

A revocable living trust allows the grantor to maintain control over their assets while they are alive. You can change the terms of the trust, add or remove assets, or even dissolve it altogether if your circumstances change.

Moreover, because the assets are held in the trust’s name rather than your own, they pass directly to your beneficiaries upon your death without going through probate court.

This privacy is a major advantage for many people who value keeping their financial affairs confidential.

Ordinarily, a revocable living trust is a good choice for individuals with significant assets or those who want to ensure that their wishes are carried out efficiently and privately after they pass away.

Are There Any Potential Drawbacks to Using a Revocable Living Trust?

While revocable living trusts offer many benefits, there are some potential downsides to consider.

  • The initial setup cost can be higher than simply creating a will.
  • You’ll need to carefully update the trust documents whenever your circumstances change, such as buying or selling property, getting married or divorced, or having children.

It’s important to weigh these potential drawbacks against the benefits and consult with an experienced estate planning attorney like myself to determine if a revocable living trust is right for you.

I Understand You Have Encountered Some Challenges With Revocable Living Trusts Over the Years. Can You Share Any Experiences?

Yes, I recall one instance where a client had created a revocable living trust several years ago but hadn’t updated it since then. When he passed away, his beneficiaries discovered that the trust document didn’t accurately reflect his current wishes or asset holdings.

This resulted in some confusion and delay in distributing the estate. It highlighted the importance of regularly reviewing and updating your trust documents to ensure they remain aligned with your goals.

I also remember a case where a client was hesitant to fund their revocable living trust fully, thinking it would be more complicated or costly.

This ultimately led to some of his assets having to go through probate anyway, negating some of the benefits of the trust. It reinforced the importance of working closely with an experienced attorney who can guide you through the entire process and ensure all your assets are properly titled.

What Advice Would You Give to Someone Who Is Considering Setting Up a Revocable Living Trust?

My advice is simple: don’t delay. The sooner you start planning for your future, the better.

A revocable living trust can provide peace of mind knowing that your assets will be distributed according to your wishes and your loved ones will be spared the hassle and expense of probate.
