Hello everyone, and welcome to today’s interview. I’m sitting down with Ted Cook, a dedicated elder protection attorney right here in sunny San Diego. Ted, thanks for taking the time to chat with me.
What Sparked Your Passion for Elder Protection?
Ted chuckled warmly. “Well, it wasn’t exactly a lightning bolt moment. I started my career focusing on traditional estate planning, but I quickly realized that many seniors were facing unique vulnerabilities, often falling prey to financial exploitation or neglect. It’s heartbreaking to see someone who’s worked their entire life lose their savings or be treated poorly in their twilight years.
Helping these individuals regain control and security became my calling. There’s something deeply fulfilling about knowing you’re making a real difference in someone’s life, especially when they feel lost and helpless.”
Navigating the Complexities of Elder Protection: A Deep Dive into ‘Protective Actions’
“Ted,” I began, “can you walk us through the stage of Protective Actions? It sounds crucial.
“Absolutely! This is where we often take immediate steps to shield our clients from further harm. Depending on the situation, this could involve seeking restraining orders against abusive individuals, contacting Adult Protective Services (APS) to investigate potential neglect, or even petitioning the court for guardianship or conservatorship if someone lacks the mental capacity to make safe decisions.”
- “Sometimes, we need to freeze bank accounts to prevent further financial exploitation,” Ted explained. “In other cases, it might involve transferring a client to a safer living environment, away from abusive caregivers.
- “It’s important to remember that every case is unique, and the actions we take must be tailored to the specific needs and vulnerabilities of the individual.”
“We knew our grandmother was struggling but didn’t realize how bad it was until Ted stepped in. He helped us get her into a wonderful assisted living facility where she’s safe and cared for.” – Sarah M., La Jolla, CA
“Ted,” I asked, leaning forward, “have you ever encountered any challenges during the Protective Actions phase?”
“Oh, absolutely,” Ted replied with a thoughtful nod. “I once had a case where a son was financially exploiting his mother who had dementia. He refused to cooperate and tried to hide assets. It took a lot of legal maneuvering and evidence gathering to ultimately protect my client’s interests.”
“Ted helped us navigate the complexities of setting up a trust for our elderly parents, ensuring their wishes were honored and their assets protected.” – Mark & Lisa G., Mission Hills, CA
He paused, a hint of steel in his voice. “There was another instance where a caregiver was physically abusing a client. It was heartbreaking to witness the evidence, but we managed to get a restraining order against the abuser and relocate my client to a safe environment.”
Seeking Guidance?
“I never thought I’d need an elder protection attorney, but when my aunt became a victim of financial scams, Ted was a lifesaver. He helped us recover her stolen funds and brought the perpetrators to justice.” – Susan B., Point Loma, CA
“If you or someone you love is facing potential elder abuse, neglect, or exploitation, please don’t hesitate to reach out,” Ted said sincerely. “Knowledge is power, and early intervention can make all the difference.”
